This User Agreement (“Agreement”) is a legal agreement between you (“User”) and the Cannabis Workforce Initiative (“CWI”), governing your use of the CWI On-Demand Learning Site and all content, materials, and services available through the site. By accessing or using the CWI On-Demand Learning Site, User agrees to be bound by this Agreement. If User does not agree to the terms and conditions of this Agreement, User may not access or use the CWI On-Demand Learning Site.
Intellectual Property Ownership and Use
All content, materials, and services available on the CWI On-Demand Learning Site, including but not limited to text, graphics, logos, images, audio clips, video clips, software, and other materials, are the property of CWI or its licensors and are protected by copyright, trademark, and other intellectual property laws. User acknowledges that CWI owns all right, title, and interest in and to the CWI On-Demand Learning Site and its content. User may not use, reproduce, distribute, transmit, display, perform, or create derivative works of any of the content or materials available on the CWI On-Demand Learning Site without the express written permission of CWI. User may not use any automated means to scrape, crawl, or index the CWI On-Demand Learning Site or its content.
User Conduct
User agrees to use the CWI On-Demand Learning Site only for lawful purposes and in a manner consistent with this Agreement and all applicable laws and regulations. User agrees not to use the CWI On-Demand Learning Site to: Engage in any conduct that would violate any applicable law or regulation; Interfere with or disrupt the CWI On-Demand Learning Site or its servers or networks; Transmit any viruses, worms, or other malicious software; Collect or harvest any information from the CWI On-Demand Learning Site; Impersonate any person or entity, or falsely state or otherwise misrepresent User’s affiliation with a person or entity; Engage in any conduct that could damage, disable, overburden, or impair the CWI On-Demand Learning Site or its servers or networks; or Attempt to gain unauthorized access to any part of the CWI On-Demand Learning Site or its servers or networks.
Disclaimer of Warranties
THE CWI ON-DEMAND LEARNING SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE CWI ON-DEMAND LEARNING SITE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO USER AND THE RESULTS OBTAINED THROUGH THE CWI ON-DEMAND LEARNING SITE. SPECIFICALLY, CWI DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES, AND 2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL CWI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS OR REVENUES, LOSS OF DATA, OR LOSS OF USE, ARISING OUT OF OR IN CONNECTION WITH USER’S USE OF THE CWI ON-DEMAND LEARNING SITE, WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHER THEORY, EVEN IF CWI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Age Restriction
User must be 18 years of age or older to use the CWI On-Demand Learning Site. By accessing or using the site, User represents and warrants that they are at least 18 years old. If User is under the age of 18, they may not access or use the CWI On-Demand Learning Site. CWI does not knowingly collect personal information from individuals under 18 years of age. If CWI becomes aware that it has inadvertently collected personal information from an individual under the age of 18, it will take reasonable steps to delete such information from its records. By agreeing to this User Agreement, User acknowledges that they are solely responsible for complying with any age restrictions or legal requirements related to the use of the CWI On-Demand Learning Site in their jurisdiction. CWI reserves the right to request proof of age from Users and to suspend or terminate User accounts that are found to be in violation of the age restriction. Please note that the CWI On-Demand Learning Site may contain materials and content related to cannabis and other substances that may be restricted to individuals of legal age in certain jurisdictions. It is User’s responsibility to ensure compliance with applicable laws and regulations regarding the use and access to such materials. By continuing to access or use the CWI On-Demand Learning Site, User acknowledges and agrees to the age restriction and the terms and conditions of this Agreement.
